water line of the Subdivider in location indicated by red line on Drawing No. A-1073, dated December 8th, 1952, attached hereto. Subdivider covenants that he is the owner of said water line and has the right to sell the same to the Company, and that there are no liens or encumbrances against the same. 2. To provide the Company with an easement satisfactory in form for said water line for the repair, mainte­nance, renewal or replacement of said water line, said easement to be five (5) feet on each side of the center line of said water main. ARTICLE II The Company Agrees: 1. Upon the execution of this agreement, upon receipt of the aforesaid easement to said water line, to pay to the Subdivider at quarterly intervals thirty-five (35$) percent of the revenue received by it from customers located within the area outlined in yellow on said map attached hereto, taking service from said water line for a period of ten (10) years from the date of this agreement, or until the Subdivider has been repaid the agreed eost of constructing said water line in the amount of $1088.00, whichever first occurs. THIS AGREEMENT shall inure to the benefit of and be binding upon the heirs, executors, administrators, successors and assigns of the respective parties hereto. - 2 - / ? - / / / m
