HEERS, and VIRGINIA R, HEERS, co-partners doing •usiness as HEERS ASSOCIATES OF NEVADA, whose address is Twin Lakes ,odge, Las Vegas, Nevada, hereinafter called "Subdivider," Party if the Second Part, WITNESSETH: RECITALS WHEREAS, the Company is engaged in the business of dis-ributing water as a public utility, in the City of Las Vegas, dark County, Nevada; and WHEREAS, the Subdivider is engaged in the development of [©exs Subdivision Nevada-1, Las Vegas, Nevada, and has made appli- :ation for water service to serve said tract; and WHEREAS, the Company is willing to serve said tract with rater, pursuant to its rules and regulations on file with the Public Service Commission of the State of Nevada; AGREEMENT ARTICLE I. SUBDIVIDER AGREES: 1, At its sole cost and expense to furnish all necessary materials and labor for the construction of, and to construct, m -he locations shown by yellow lines on Exhibit "A," dated October 16 L953, attached hereto and by this reference incorporated herein, the following: (a) Approximately 6,645 LF of 6" cast iron water mains. (b) Approximately 3,310 LF of 8" cast iron water mains. (c) Approximately 1,070 LF of 12" cast iron water mains. -1- —
