CONTRACT; AUD. of AGREEMENT ^THIS AGREEMENT, made and entered into as of the / £ ^ day ---- , 1954, by and between LAS VEGAS LAND AND WATER /COMPANY, a corporation of the State of Nevada, hereinafter called Companyy" Party of the First Part, and STEWART OGDEN APTS., INC., a Nevada Corporation, whose address is 120 Cleveland Street, Las Vegas, Nevada, hereinafter called MSubdivider, n Party of the Second Part, WITNESSETH: RECITALS WHEREAS, the Company is engaged in the business of distribu­ting water as a public utility, in the City of Las Vegas, Clark County, Nevada; and WHEREAS, the Subdivider is engaged in the development of Block 6 of Noblitt Addition, Las Vegas, Nevada, and has made applica tion for water service to serve said tract; and WHEREAS, the Company is willing to serve said tract with water, pursuant to its rules and regulations on file with the Public Service Commission of the State of Nevada; AGREEMENT ARTICLE I. SUBDIVIDER AGREES: 1. At its sole cost and expense to furnish all necessary materials and labor for the construction of, and to construct, in the location shown by yellow lines on Exhibit "A”, dated April 20, 1954, attached hereto and by this reference incorporated herein, the following: a.
