SOUTHARD, doing business under the fictitious name of SOUTHARD -and DOWHEY, does hereby sell, assign, transfer and set over to LAS VEGAS LAND AND WATER COMPANY, a corporation of the State of Nevada, (hereinafter called,!Companyw), all his right, title and interest in and to that certain six (6) inch cast iron water line in location described in Article I, Section 2 of that certain agreement between the parties hereto of date November 4th, 1947, identi­fied as Company’s "N”L.D. 1914, to which reference is hereby made and the same incorporated herein, together with all valves, fittings and valve boxes connected with said water line. The said A.M. SOUTHARD warrants that he is the owner of all the property hereby conveyed and that the same is free and clear of all en­cumbrances including dll material and labor claims attaching thereto, and that he will at all times hereafter defend the title to the same against any and all persons lawfully claiming, or to claim the same.
