The agreement, however, fails to require Union Pacific to use "sound engineering practice" in making the relocations or to prevent interruption of water service by the District. Accordingly, we have drafted Section 18A to cover this contingency. 7 . Removal of Power Lines and Pump House. Section 15 requires the power line supplying the pump house to be moved within one year. Section 16, on the other hand, requires the removal of the pump house within two years. If the pump house is to continue in operation it will obviously require power. Accordingly, the removal of the pump house power line should be changed from one to two years. 8. Payment of Costs of Relocation from Trust Fund (Section 21). This section permits the District to terminate and take down the trust fund upon completion by the District of relocation. With respect to Union Pacific, it provides for the termination of the trust and take down of the trust funds upon commencernent of relocation. This has been revised to provide that both the District and Union Pacific may take down the trust fund upon completion. Comment: Under Union Pacific's draft, Union Pacific would be able to finance the cost of construction from the trust funds and would not have to resort to other funds for that purpose. 5.
