Vegas,Lincoln County,Nevada. 190 Dear Sir: Court will open on the eighteenth day of November,hence,you can put that date in the summons and serve it upon Mr. Samuel Yount, You irakd had ,perhaps,better serve it yourself,then you can make out and sware to the return when you come up here. Yount will KicK I know; but it is one of those public duties that a man obligates himself to perform,by voluntarially putting his name to a paper,oust to accomi-date a person,the result of which may cause him a great deal of annoy­ance and expense. But it is a duty that must be performed. You see, there is no way in the world,as our law now is,to prove this will other than one of the subscribing witnesses being present in Court. And theraL is no way to bring those people to terms and by so doing execute the wishes of the deceased,other than proving the will and disposing of the property in accordance with law—hence—under these circumstances,Mr Yount should^complain. If all parties had been honestly disposed the matter might have been fixed up without administering upon the estate;but it seems as if they were not. Some of them wants,and have gotten their money,and they want to beat some of the other creditors out of theirs,and some one repre­senting the Hearst eatate will Keep that which the creditors shoulEL-have, put it in his pocket,and go down town and have a good wine supper. I am surprised at the action of Mr.Fred Clark,representing the Hearst estate as he is. If it had been some one in the country not aversed in commercial practices we might aixifera* attribute it to ignorance;but a man like Mr.Clark,living in SanFrancieco,representing an estate like the Hearsts having access to the best lawyers in the Republic,acting as he is doing,plainly shows what he will do if he gets an opportunity. We will call upon him to give an account of his stewardship in this particular matter. Therefore,tell my friend Sam.Yount,not to feel hard against any one now acting.lt was not our falts that he signed that will as a witness,but he having signed it he has placed himself in the same position as the unwise man who built his house upon the sands,when the flood came it took his house,and now the necessary time has come for having Mr. Yount in Court,and he can't get out of it any more than the unwise man could keep the flood from washing away his house. Now,take a ride over there yourself,serve Sam.read# this letter to him and call the boys up and treat them and he will laugh over it and come.I send you two of the notices I caused to be put up,put one up at Goods Springs,and send one to Sandy.
