To VIOLA BURNS, City Clerk and Ex-officio License Collector of the City of Las Vegas, Clark County, Nevada: LAS VEGAS LAND AND WATER COMPANY hands you herewith the sum of $300.00 for license for water company, and the sum of $40.00 for license for lodging house, for the last quarter of the year 1938; but said amounts are paid to you under protest, and so as to avoid the penalty prescribed by Section 16 of Ordinance No. 243; the grounds of said protest are as follows: (l) That said Ordinance No. 343 is unconstitutional and void; (3) That said Ordinance is discriminatory insofar as the business of this protestant is concerned; (3) That the rates of said license fees are excessive; (4) That said Ordinance No. 343 was not enacted in accordance with the provisions of the Statutes under which the City of Las Vegas was created and derives its powers; (5) That said Ordinance is in conflict with other statutory provisions enacted by the State of Nevada; (6) That the revenues produced by the collection of the license fees prescribed in said Ordinance are far in excess of the amounts necessary for the conduct of the City's business and in excess of the amount necessary for the City to expend in regulating the business of this protestant.
