Subdivider to furnish Company necessary easements where pipe lines are to be laid in other than dedicated streets and alleys, together with B i n of Sale, Title Report and Policy of Title Insurance; be, and the same is hereby, ratified, approved and confirmed. On motion duly seconded, it was RESOLVED, that the action of Vice President Reinhardt and Secretary in executing agreement r,N"L.D. No. 2709, dated August 11, 195>3, between LVL&WCo., called "Company”, and L. T. Garrett, called "Subdivider", providing: 1. Subdivider to pay Company #638.00 estimated cost of installing approximately 130 feet of 6" cast iron water main in alley north of Fremont Street, extending westerly from Bruce Street to serve property being developed by Subdivider; 2. Company to refund to Subdivider at quarterly intervals y~>% of monthly revenue received by it from customers taking direct service from water main so installed for a period of ten years from date of completion of said in­stallation or until Subdivider has been repaid the actual cost of installation, whichever first occurs; 3» Company to own said water main; i|. Subdivider to furnish Company necessary ease­ments where said water main is to be laid in other than dedicated streets and alleys, to­gether with Title Guarantee and Policy of Title Insurance; be, and the same is hereby, ratified, approved and confirmed. “3-0-
