January 21, 1942 Mr. 0. B. Sexton Public Service Commissioner I - Oar ton City, Hevada Bear Mr. Sextons 1 hart discussed your proposed Mule 9(o) with Messrs. Bracken end MoMamee and they will send you a further suggested draft for your consideration. I an very sorry that you do not feel that the word "adjacent* is a satisfactory word in our proposed rule as we deliberately used such a word to giro the rule a reasonable amount of flexibility* In other words, we felt that the Water Company would be more than willing to make reasonable extensions of its existing mains where the development would warrant it, but we did not feel that we should be obliged to extend our mains an unreasonable distance for the purpose of getting 20 new consumers of water. As I have stated, the present olty limits are in some instances far beyond the extremities of our mains, and there is no development in that general direction. I have been cheeking some definitions of the word “adjacent* and without siting the oases to you should like merely to give you the benefit of some of these definitions* *Adjacent means near to or in the vicinity of and does not necessarily mean touching or bordering upon.* "Adjacent means next to or near, neighboring, while adjoining means touching or contiguous.* "Adjacent does not mean adjoining, but signifies convenient, near to or in the neighborhood.* "Adjacent does not mean adjoining, but in the neighborhood of or convenient or near to the place specified.*
