I Personal) Mr. Frank strong: Further in connection with my letter February 3rd concerning compliance with Fair Labor Standards Act of 1938. I attach hereto office memorandum made by Mr. Folger after conference with Power Company Officials and Mr. Wilkes, formerly of the hours and wages division, of Labor. Department ' While I am not familiar with the Act, undoubtedly there are numerous provisions which only an expert could be familiar with, and it would be to our advantage to have the required data compiled by someone who is thoroughly familiar with the requirements of the Act. For instance, retro-active payments should be made on basis of hours worked and not on the basis of hours not worked but paid for, for "instance Saturday afternoon. I would like to employ the services of Mr. Wilkes when he has finished with the Power Company (which I understand will be around March 1), as well as his Secretary who types the required reports. Incidentally he can offer suggestions regarding changes in methods of time keeping, etc. to conform to requirements of wage and hour division. Confidentially I understand the Power Company is paying Mr. Wilkes 1600.00 per month plus t|l30.00 monthly for the Secretary. I estimate we will require his services for about two weeks.
