In case the C o n tr a c to r does not p r e s e n t a c la im i n w r i t i n g t o the E n gin eer on account o f the d i s s i m i l a r i t y in th e work by rea son o f such change w it h in te n days a f t e r such change has been e x p la in e d , th e Con­t r a c t o r s h a l l be f o r e v e r estopped from making any c la im t h e r e f o r . S e c t io n 10. TERMS OF--PAYMENT The terms o f payment s h a l l be as f o l l o w s : During th e p r o g r e s s o f th e work th e E n gin eer s h a l l cause e s tim a te s t o be made o f th e amount o f work done and/or m a t e r ia ls fu r n is h e d d u rin g each c a le n d a r month and about th e t w e n t ie t h day o f th e su cced in g month th e v a lu e o f th e same based on th e p r i c e o r p r i c e s a f o r e s a i d , l e s s a r e s e r v e fund o f te n ( 1 0 ) p e r c e n t , which ’s h a l l be h e ld by th e R a ilr o a d Company as s e c u r i t y f o r th e c om p le tio n o f th e whole work i n i t s s e v e r a l p a r t s , s h a l l be paid t o th e C o n t r a c to r and i f , at th e tim e h e r e in s p e c i f i e d f o r th e c om p le tio n o f th e work, each and e v e r y p a r t o f th e work has been done in accordance w ith th e p r o v is io n s h e r e o f and d e ­l i v e r e d up t o th e R a ilr o a d Company f r e e o f a l l cla im s and l i e n s and, i f th e C o n t r a c to r s h a l l have done and perform ed a l l th e covenants and u n d erta k in gs on th e p a r t o f th e C o n tr a c to r h e r e in mentioned t o be done and p erform ed , th e R a ilr o a d Company s h a l l , s u b je c t t o th e p r o v i s i o n s o f S e c t io n 11 h e r e o f , pay o v e r t o th e C o n tr a c to r a l l o f s a id r e s e r v e fund. S e c t io n 11. RESERVE FUND In the ev en t t h a t th e bond g iv e n by the C o n tr a c to r as r e q u ir e d in S e c t io n 4 h e r e o f i s i n s u f f i c i e n t , in th e o p in io n o f th e R a ilr o a d Company, t o p r o t e c t i t s i n t e r e s t , th e R a ilr o a d Company s h a l l not be o b l i g a t e d t o pay s a id r e s e r v e fund o f ten (10) p e r cen t t o th e C o n t r a c to r im m ed ia tely upon th e com p letio n o f th e work, but s h a l l have th e r i g h t , a t i t s o p t io n , t o r e t a i n such p o r t i o n o f s a id r e s e r v e fund as i t d e s i r e s u n t i l th e time a l l o t t e d by law f o r th e f i l i n g o f l i e n s upon o r a g a in s t th e work s h a l l have e x p ir e d , and u n t i l a l l l i e n s f i l e d upon o r a g a in s t th e work s h a l l have been f u l l y p a id .
