J e f f e r s President, Omaha, Nebraska, Dear Sir: R e f e r r i n g to m y letter J u l y 37th, 1939 to Mr, Strong, c o p y to you, regarding complaint of the Stewart heirs that w e w e r e not delive r i n g w a t e r during the simm e r months to the Stewart Burial Plot, as reserved in their deed to the R a i l r o a d Company: m i t t a l and letter from the Stewart h e i r s concer n i n g the a l l e g e d da m a g e to their property d u e to lack of w a t e r thereon d u r i n g the past summer. This is a pro b l e m we have had to c o n t e n d w i t h e a c h summer for the past number of years, a n d it w a s particularly a g i t a t e d by the heirs d u r i n g the past summer w h e n w e were faced w i t h a n acute shortage of water. is of course exhorbttant, and I have alw a y s felt that they really have n o particular interest in the welfare of the trees, Judging f r o m the laok of c a r e g i v e n their b u r i a l plot, but are m e r e l y standing on their c o n t r actual rights in the h o p e of securing f i n a n c i a l gain f r o m the railroad company. D u r i n g the past summer. G e n e r a l Attorney Me Named, m y assistant F o l g e r , a n d myself made regular inspections of the b u r i a l plot, a n d w h i l e it is true that there w e r e periods d u r i n g w h i c h no w a t e r was deliv e r e d to the tract b e c a u s e there w a s none available, yet at other times water w a s deliv e r e d there, and w e d i d not f e e l that the temporary laok thereof caused them a n y ac t u a l damage.
