I beg to acknowledge re c e ip t o f your fa v o r o f th e 13th in s t. a s k iig whether o r not under the c o n t a c t w ith the o ld Bouton Water Company, the Seaside Water Company, as successor o f s a id Bouton Water Company, has any r i # t to charge ns fo r a l l w ater'w hich our company d esires to use a t Bong Beach and Terminal Isla n d , except fo r bath house purposes. Upon examination o f the lease made by the Terminal Railway Company to the Bouton Water Company, o f July 16, 1900, whereby the Bouton Water Company obtained the r ig h t to la y it s pipes along our r ig h t of way, I fin d th a t th e con d ition o f the lease was th at the Bouton Company should fu rn ish to the R a ilro a d Company " a l l the water needed by the corporation f o r use by i t s locom otives and cars a t any p o in t alon g said rig h t o f m y *. Under th is clause i t i s my opinion th a t we would not have the r ig h t to demand fr e e water f o r a l l purposes, but our r ig h ts to fr e e water are lim ite d to the s p e c ific purposes mentioned in the le a s e , namely, fo r locom otives and cars.
