Ka >% f • % l l i t i furnishing of such necessary easements, to order the necessary 2 pipe, fittings and other materials and upon the arrival of pipe 3 and materials aforesaid at Las Vegas, to proceed with the installa- 4 tion of said water mains and fire hydrant connections along the 5 lines so staked upon the ground by the Subdivider, and to complete 6 the said installation with reasonable diligence* Said water main 7 shall consist of 6" Cast Iron Pipe, 8 2, To pay to the Subdivider at monthly intervals, 9 thirty-five percent (35%) of the monthly revenue received by it 10 from customers; located within Radlick Park Estates Subdivision 11 taking water from the water main so installed hereunder, for a 12 period of ten (10) years from the date of the completion of said 13 installation, or, until the Subdivider has been repaid the actual 14 cost of the line so advanced by it (exclusive of the cost of con- 15 structing said fire hydrant connections) whichever occurs first. 16 ARTICLE 111 17 It is mutually agreed: 18 1, That the water mains so installed shall be and re- 19 main the property of the Company, 20 2, Should the actual cost of the installation of said 21 water mains exceed the estimated cost of $5,350,00 then and in that 22 event the Subdivider will pay the excess to the Company, upon demand f 23 if said actual cost be less than $5,350,00 then the Company will pay 24 to the Subdivider the difference between said estimated cost so 25 advanced and the actual cost. 26 - 3 - A-/**
