The le g is la tiv e grant o f power to the city to maintain the proceeding recited that any incorporated city is hereby authorised to construct, condemn and purchase, purchase, acquire, add to, m in tain , operate or lease cable, e le c tric and other reailways within the lim its of such city fo r the transportation of freigh t and passengers, another section provides that whenever the city council deems i t advisable that the city sh all acquire the public u t ilit y mentioned, that i t provide therefor by ordinance, which ordinance sh all specify and adopt the system or plan proposed and declare the estimated cost thereof, etc. and the same is submitted fo r ra tific a tio n to the qu alified voters at a general or special election* the act also provided that i f i t is necessary to condemn land or other property fo r such purpose the city shall-provide therefor by ordinance,
