In the event any liens or claims are filed against said water main installed hereunder by any person or persons performing labor upon or furnishing materials used in the construction of said water main, the Subdivider agrees, at his own expense, to defend any action brought on •Jw < i t .' I| \• » • such liens or claims, and the Company shall not be obligated to make monthly refund, as provided in Article II above, until the Subdivider shall have satisfied such liens or claims. 3. It is understood that the actual cost of said water main means the cost of all labor and material used in construction of said water main. b. This agreement shall inure to the benefit of and be binding upon the heirs, executors, administrators, successors and assigns of the respective parties hereto.
