Smith I enclose herewith copy of a letter which I received from State Engineer Hugh Shamberger under date of September 15, 1954, together with a copy of my reply thereto. matter, when use of the shop well was investigated in February and March of 1952, there was some doubt as to our ability to transfer all of the 2,5 e,f.s. under permit 7200, unless we could develop and appropriate that amount of water to beneficial use at the new point of diversion. At that time it was determined that we should at least try to transfer the entire amount, hoping that no question would be raised as to the use of the water when transferred. Our hope in this regard was not in vain and the entire amount was transferred under Permit 15140, However, someone apparently got out a sharp pencil and has now called Mr, Shamberger^ attention to the fact that we can not appropriate this amount of water at the new point of diversion, being the existing shop well in the railroad yards. Consequently, it has been necessary for me to advise the State Engineer that it is possible to produce this amount of water with forced pumping for a relatively short period of time, I believe he will go along with this statement even though he knows that the “relatively short period” may only be a few seconds or a few minutes.
