If such contract is executed by the Sub- divider and all money required to be deposited by the Subdivider with the undersigned under the terms of said contract is deposited by the Subdivider within ninety (90) days from the date hereof, 2. The plans and specifications for and the location of the said pipe lines shall be satis­factory to the undersigned and the cost of the work of constructing said pipe lines to be re­funded by the undersigned to the Bubdivider under the provisions of said Rule f shall be in an amount satisfactory to the undersigned, 3. Said pipe lines shall be laid in public streets or alleys or on a private right of way furnished by the Subdivider to the undersigned
