\ upon the total cost of the work performed by Union Pacific un­der this Section 3* The right to construct said new pipe lines referred to in this Section 3 shall include the right to construct pumps, valves, connections and appurtenances* Section 4 * In the event the District and Union Pacif­ic are able to agree upon the type and nature of the pipelines and pumping stations to be constructed by the Union Pacific pur­suant to the provisions of Section 3 hereof, said new pipelines, appurtenances and pumping station shall be constructed, and said pipe lines shown by broken black and red line on Exhibit shall be removed, under the joint direction of the District and Union Pacific pursuant to a contract to be entered into between the Union Pacific and a contractor after bids have been obtained therefor* In the event the Union Pacific and District shall be unable to agree upon the type and nature of said new pipe lines and pumping station, Union Pacific shall nevertheless have the right to construct said facilities as provided in Section 3 end to remove said pipe lines shown by broken black and red lines on Exhibit "i* pursuant to a contract to be entered into between the Union Pacific and a contractor after bids have been obtained therefor* In either event the contract price thereof plus 1©# for supervision shall be considered as the cost to Union Pacif­ic of constructing said new pipe line facilities and pumping station and removing said existing pipe lines. Section 5* In the event the pumping station referred to in subparagraph (c) of Sections 2 and 3 hereof shall be re­located as therein provided, Union Pacific agrees to grant to the District by separate instrument a parcel of land approxi­mately 5>000 square feet in area as a site for said relocated pumping station shown by green square near point R on Exhibit 1JSA1*> said grant to be subject to reversion to the grant or, its 6.
