Water Supply- Starr, Utah. Los Angeles, C a lif., October 21, 1927• I m e 519-R Mr* ft. L. Adamson: Referring to attached abstract of title s (1 ) hoe. 1-2-3-* indicate that the eater from this spring was used as early an 1865 and various transfers indicate that iteo has been more or less continuous. (2 ) Mo* 5 grants to the Utah Central ay. Co., predecessor in interest of this Company, sufficient eater for railroad use* We are infestsed that this eater was used only during a short time and for many years prior to 1912 supply eaa taken from a well near the spring. Correspondence la the old files indicates that this well was sunk in 1883 by George Fatten (See Mo. 7) and that an agreement was made between the Railroad Company and Ceorge Fatten by whieh the Company was to use water from the well but on failure of same could re-establish its right to the waters in the spring, fe have made an exhaustive search of the County Records and also made inquiry of the Salt Lake and Omaha Offices and have been unable to locate this contract* According to the various entries in this abstract the water from this spring has been parcelled out without any recognition of the rights of the Railroad Company as conveyed by Ro* 5* See Ro’ e* 6 to 13* Would suggest referring this matter to the Law Department to determine the present rights of the Company under this deed.
