That certain agreement "between the parties hereto, dated October 10, 191*7, identified as Agreement "N"L.D. i860, is hereby terminated as of the date hereof, and the Company agrees to promptly refund to the Subdivider the sum of ONE THOUSAND FOUR HUNDRED NINETY and NO/lOO DOLLARS ($1,1*90.00), deposited by the Subdivider with the Company pursuant to Article I, Section I, thereof. 1*.
