CONTRACT y A S S I G N M E N T R e c i t a l s : Under date of November l\., 19k-7» LAS VEGAS LAND AND WATER COMPANY, therein called "Company”, entered into a certain Agreement with A. M. SOUTHARD, doing business under the ficti­tious name of SOUTHARD and DOWNEY, therein called "Subdivider", which Agreement is identified as being Las Vegas Land and Water Company "N" L.D. lpllj-, wherein the Company agreed that on cer­tain conditions it would complete the installation of water mains to and within a portion of Block 8 and 10 of Mayfair Tract No. 2, as per plat thereof on file an d of record in Book 2 of Plats at Page Ij_7, Clark County Nevada Records; And wherein the Subdivider agreed to pay to the Company the actual cost of the installation of said water mains; And wherein the Company agreed to pay to the Subdivider at monthly intervals fifty per cent of the monthly revenue re­ceived by it from customers taking water from the water mains so installed thereunder, for use in Lots 1 to 6 inclusive of Block 10,and Lots 19 to 2I4. inclusive of Block 10, and Lots 12 to 28 inclusive of Block 8 of said Mayfair Tract No. 2, for a period of ten years from the date of the completion of said installation or until the Subdivider has been repaid the actual cost of the line, so advanced by him, whichever occurs first; And whereas, the Subdivider did pay to the Company the total cost of installing said water mains; And whereas the Subdivider desires to assign to ‘ National Ice Company of Las Vegas, a corporation, and Milton W. Keefer all moneys to be paid hereafter by the Company to the Subdivider as in said Agreement provided; NCW, THEREFORE, for value received, A. M.
