'• - M/ pTHmIS Aj GREEMENT, made and entered into this m day of 1955, by and between LOS ANGELES & SALT LAKE RAILROAD COMPANY and its Lessee, UNION PACIFIC RAILROAD COMPANY, corporations of the State of Utah (hereinafter collectively called "Railroad Company"), and LAS VEGAS VALLEY WATER DISTRICT, a public corporation of the State of Nevada (hereinafter called "Licensee"), WITNESSETH: RECITALS WEREAS, the Licensee desires to construct, maintain and operate a 36-inch reinforced concrete encasement pipe enclosing an 18-inch water main across the right of way and under the tracks of the Railroad Company at M 0P* 334*94 in Las Vegas, Nevada, in the location shown by yellow lines on the map attached hereto, dated February 24, 1955, marked Exhibit "A", and WHEREAS, the Railroad Company is willing to grant such permission upon the following terms and conditions: AGREEMENT NOW, THEREFORE, it is mutually agreed by and between the parties hereto as follows: Section 1. RAILROAD COMPANY GRANTS RIGHT* In consideration of the covenants and agreements herein con­tained to be by the Licensee kept, observed and performed, the Rail road Company hereby grants to the Licensee for an indefinite period subject to the terms and conditions herein stated, the right to construct and to maintain, repair, renew and operate one 36-inch reinforced concrete encasement pipe and one 18-inoh water main - 1 - § msm
