Sohall Jan# 27, 1949 The Nevada legislature of 1947 (Chapter 167) oreates a water district id las Vegas Valley# The Act provides that the district may acquire by pur­chase or condemnation any property whether or not it be devoted to public use or not, and provides that in the event of condem­nation, the condemnation suit shall be carried on under the lavs of Nevada. The condemnation law of Nevada (Section 9158) of the Nevada Compiled Laws, provides that proceedings under the con­demnation statutes must be brought in the District Court of the county in which the property, or some part thereof is situated. We may be faced with a condemnation suit directed against the las Vegas Land and Water Company and the Union Pacific Railroad Company, owners of the water-bearing lands and | -with you would check into the question, whether we are restricted to the state courts under the above mentioned pro­vision or whether, because of the diversity of citizenship in connection with the Union Pacific, we could have the case transferred to the Federal Court* EEB:AF
