Ecus• W * © February 1, 1952 Hs advised Mr, Allen that he thought a petition for rehearing could be drawn which would not be embarrassing to the Commission, Mr, Allen then stated that if w® filed a petition for rehearing, he would give it serious consideration, I have discussed the matter with Mr. Reinhardt and w© both feel that w© should file a petition for rehearing and give the Commission an opportunity to re-open the case. If it does not do so promptly, there will be no reasonable alternative except to proceed with the court action, foday I have filed a petition for re-hearing and am enclosing to you, and sending to each of the parties to whoa a copy of this letter is going, a copy thereof. If the rehearing is granted, I propose to have the bulk of the testimony put in by members of the staffs of Mr. Hulsiaer and Mr, Sutton. However both Mr. Reinhardt and I agree that Mr, ¥©he should be retained to prepare some exhibits relating to a forecast of operations for the year 1952, I have asked Mr. Veh© to be ready to start preparation on short notice, I will keep you advised of further developments in the case.
